a driving assist apparatus includes a photographing part mounted in side mirrors switchable between a first state where a driver can see a vehicle rear side and a second state where a protruding margin of the side mirrors in a width direction of the self-vehicle is small, and having different photographable areas between the first and second states. a control part performs a driving assist based on images photographed by the photographing part. the control part is configured to judge whether the side minors are in the first or second state based on the images, and to continue the driving assist when the side minors are judged to be in the first state and suspend the driving assist and notify to the driver that the driving assist is not carried out when the side minors are judged to be in the second state.
